SPORTS BETTING TERMS AND CONDITIONS

All players who want access to our private area must open an account with Iberobet, Ltd. Players will open a betting account with Iberobet, Ltd and deposit the first amount.

The minimum deposit will be indicated at all times but will never be less than 15€.

A player may use the amount in this betting account to place sports bets.. Subject to the relevant terms and conditions, players may realise any winnings on pool betting, by crediting their betting account. Any payout to players may therefore be only made through their betting account kept at Iberobet, ltd.

Each sports bet has two parties on one hand. The company Iberobet, ltd. (company number C-41347 Malta),with registered address, level 2 cobalt house Notabile Rd Mriehel Malta, promotes sports and general bets and guarantees players money deposited and the payout to the winner for each events, under the Maltese law and the Malta regulator, the Lotteries and Gaming Authority (http://lga.org.mt). The provisional license number is LGA/CL3/362/2007 issued on the 24 October, 2007.

Relevant rules, terms and conditions may be changed from time to time at the sole discretion of Iberobet, ltd and it is the responsibility of the player to regularly review these Terms and Conditions to see whether any changes or updates have been made.

Under age (18) persons cannot utilize to the service, Signing upon the service is an implicit declaration of adult hood. Iberobet, ltd. reserves the right to cancel bets/wins made by minors. The identification could be completed, in the case of any suspected Apostandum could need from the player a copy of bill, credit card or another personal identification to confirm the identification by email or fax.

Apostandum permits one active account per Player. If duplicate accounts for the same player are identified, the company reserves the right to cancel any additional accounts. In such an event, any winnings and/or promotional awards gained from additional accounts will automatically be forfeited. Transferring of accounts is not allowed under any circumstances.

Transactions to and from the betting account are cleared in Euro. Thereafter the money will be, based on the daily exchange rate of the chosen currency, changed between the currency of the account and Euro. Under no circumstances will apostandum allow transfer funds between Player Accounts.

During the registration process, apostandum reserves the right to request information from customers that can be used to verify their identity - name, address, date and place of birth, telephone number and email address, etc. This information may include but is not limited to copies of identification documents, credit cards and / or utility bills. This information will be used to cross-reference with registration information.

Any and all information provided to Iberobet, ltd. by the player must be correct and complete. The player undertakes to notify Iberobet, Ltd any change in the registration details. In the event that any information provided to Iberobet, Ltd. becomes incorrect or incomplete, Apostandum reserves the right to cancel any bets as well as winnings, block betting accounts and retain payments to players.. The player is liable for any damage and costs arising out of false or misleading information. If any deliberately false or misleading information is furnished, all transactions on the betting account shall be declared invalid.

Residents from the USA and Turkey are not allowed to open an account. Online gambling may be illegal under the laws of your country of residence or abode. In such a case, you may not make use of the services provided by Apostandum. Apostandum will not assume any liability whatsoever in this regard and will not reimburse players for any losses suffered by them as a consequence of the violation of any legal provisions that may be applicable to the player. Legal players must ensure that they act in accordance with the legal statutory provisions applicable to him/her from time to time.

Any suspicious financial transaction may be reported to the competent authorities for investigation, this to prevent any attempt of money laundering.

Apostandum cannot accepted liability in any case and under no circumstance for any damage or loss directly or indirectly caused by internet site, its contents or the incorrect its contents by third parties

LEGAL SITUATION

Case A

In order to observe the Unlawful Internet Gambling Enforcement Act of 2006, Iberobet, Ltd. will not maintain business relations with players who:

Are permanently resident in the United States of America

Have a US American bank account or use any US-based payment method.

In the instances mentioned above there is a legal prohibition for a player to use any products or services offered by Iberobet Ltd; Any resulting activities revealed by Iberobet Ltd. will result in the immediate closing of the respective betting account.

Case B

As a result of the amendment of the “Law Regarding the Organisation of Betting and Gambling on Soccer and Other Sports Events” in the Republic of Turkey, Iberobet, ltd will not maintain business relations with players who:

are permanently resident in the Republic of Turkey

Have a Turkish bank account.

In the instances mentioned above there is a legal prohibition or a player to use any products or services offered by Iberobet Ltd; Any resulting activities revealed by Iberobet Ltd. will result in the immediate closing of the respective betting account.

Also, in order to observe any new laws enacted in a particular jurisdiction Iberobet Ltd. will could close the market affected and the same conditions as explained above will abide. (Case A and B).

PLAYER / CUSTOMER IDENTIFICATION

It is the player’s responsibility to make sure they are legally allowed to gamble.

Iberobet Ltd. will require players to submit certain documents as proof of identity for reasons of security. Iberobet Ltd. reserves the right to retain any winnings until the required documents are received. Documents can include the following:

A copy of a valid ID issued by the competent authority of a recognised state/country, e.g. passport, personal identity card, driver’s licence. In verifying the player’s identity we may also ask you for a utility bill (for example gas, electricity, telephone) or a lease;

b) A copy of each credit card (front and back) used for making deposits to the betting account of the player.

Iberobet Ltd. reserves the right to refuse any bets submitted to us or limit the stake, without giving a reason. The bookmaker will accept a bet duly placed by the player/customer by mouse-click, subject to these Terms and Conditions, provided that sufficient funds are available in the betting account, without the need to issue a confirmation, at the corporate seat of the company. Any later correspondence (e.g. notices, account information, etc.) will not have any effect whatsoever on the previous conclusion of a betting contract.

A bet accepted in such a manner may not be changed or cancelled by the player in arrears. Apostandum, however, reserves the right to cancel any bet up to the start of the event, without giving any reason thereof. After an event has started, Apostandum may cancel any bets provided that players are in violation of these Terms and Conditions as applicable from time to time. In particular if they is suspicion of manipulation or suspecicion of collusion or forming a syndicate of players, keeping duplicate gaming accounts or using front men for placing bets.

In the cases mentioned above there is a legal prohibition to use any products offered by Iberobet Ltd.; any activities in this field revealed by Iberobet Ltd will result in the immediate closing of the respective accounts.

Deposits

Apostandum provide users with different methods of payments to be able to perform deposits in your account. Accpeted services will be paysafecard, ukash, Visa, MasterCard, and also to through bank transfers to the accounts of Apostandum.

Depending on the payment method used to carry out the transaction, the transfer will be effected within a maximum period of five working days.

Apostandum could charge up to 5% in payment processing fees incurred fron the payment gateway. Payment method will always publish in the web site and must be accepted implicitly by the customer.

Apostandum confirms that is not a financial institution, consequently any funds deposited in your account do not gain interest.

Only the records kept by the bookmaker will be relevant to ascertain the content of bets. A statement of account may only be modified to remedy an obvious error and/or a typographical error or an error in calculation.

Withdrawals

For the withdrawal of funds is always set a minimum amount to compensate the bank charges, etc.

The withdrawal of funds must always be carried out by the user himself and never between accounts of users or by third parties. Inactive / Dormant Accounts

If there are no transactions in your account for more than 12 months, the account will be classified as "Inactive / dormant”

Player Accounts that remain inactive for a period of 1 year or longer will be closed. Apostandum will do its utmost to contact the player so as to refund the balance within the account, if however this is not possible, the funds will be forfeited.

Privacy Policy

All data collection will be the minimum information to take a bet and operate.

The personal data will be not transferable to third parties. The player could be the possibility to access and modify this data.

Third parties may be given access to personal internal information only when a provable need to know basis exists, and when a costumer non-disclosure agreement has been signed.

It should be noted that all data may be accessed by the Lotteries and Gaming Authority, Malta at any point in time. This requirement is for regulatory and compliance purposes only.

Anti Money Laundering

Apostandum do not permit any unlawful transactions to take place. In the circumstances that Apostandum detect any suspicious transactions, the account will be blocked and Apostandum will take the necessary action which may include informing the LGA or any another competent authority.

All transaction are checked by electronically thus enabling the identification of fraudulent transactions. Apostandum provide standard fraud management tools, such as cvv2 validation and 3D secure, verified by Visa.

All economical transaction are tracable to individual players. The company may limit the amount that can be deposited to avoid any money laundering issues that may be perceived by the company.

In application of the legal requirements of the Anti money Laundering Act, the company is duty bound to report to the relevant authority where there are reasonable grounds that a money laundering offence has been or is being committed.

INTERNET RESPONSIBILITY

Only the amount registered and/or confirmed by the bookmaker will be regarded as the stake. Under no circumstances will Apostandum be liable for any damage caused by any incorrect, delayed, manipulated/rigged or abusive transfer of data via the internet. Apostandum will take any technologically and financially reasonable action so as to protect the user information saved by Apostandum but will not be liable if third parties obtain control of, or process, user information despite such action being taken. It is agreed by common consent that no claims for damages may be asserted against Apostandum in any such circumstance. When handling the information pertaining to players, Apostandum will observe the relevant statutory data protection provisions. All data will be processed in an automated manner and only be disclosed to third parties subject to the written approval of the player unless such disclosure is imperative under the legal provisions as applicable from time to time or necessary for pursuing any claims of Apostandum in connection with sports bets.

PLAYER/CUSTOMER CONDITIONS

The transfer of data for online gaming requires the use of codes (username and password) chosen by the player. Apostandum will not be held liable for any abuse of the betting account through a third part use of the player’s username and password. We expressly state that the username and the password must be kept secret and confidential at all times as all transactions via the account for which the username and password must be entered will be for the account of the player.

The username and password should never be disclosed to third parties. It is the player’s sole responsibility to keep his/her username and password secure. The player cannot make any claims whatsoever from a third party unlawfully placing bets by using his/her password and username.

Apostandum proceeds on the assumption that each player logging into the system with the correct combination of username and password actually is the lawful account holder/player/customer. It is in particular not permissible to place bets on behalf of others, on the betting accounts of third parties, by forming syndicates of players or in conspiracy with third parties. Apostandum reserves the right to close betting accounts, cancel bets and retain the payment of funds if the account holder has made his/her account available to third parties, places bets on behalf of or in the name of third parties, in conjunction with third parties, in groups/syndicates of players, or in violation of other provisions of these Terms and Conditions.

Apostandum reserves the right to close betting accounts at any time without giving any reasons. Should any player open another betting account in his/her own name or in someone else’s name or in conjunction with one or several persons after his/her account was closed/limited for any reason whatsoever, Apostandum reserves the right not only to close those accounts but also, at any time, to cancel any bets placed. Apostandum further reserves the right to cancel any bets in particular if there is a justified suspicion of an event or a bet placed thereon being manipulated or a suspicion of circumventing the maximum win/stake.

Apostandum reserves the right to charge a processing fee on any deposits which were not, or only partly, spent on play should the player wish to withdraw funds. Such processing fee may amount to up to 5% of the amount deposited. Such a withdrawal will, as a rule, be made in the same manner as the respective deposit. In order to validate the identity of the player, withdrawals may in certain cases be made only by bank transfer.

Apostandum allows you to open only one account per person. The use of identical e-mail addresses in various Apostandum accounts is prohibited. Should players open additional accounts either in their own name or in the name of another person, Apostandum will be authorised to close those accounts, to cancel any transactions carried out or bets placed and call in any bonus money credited.

Each player/customer is obliged to read and acknowledge the Terms and Conditions as applicable from time to time before a bet is placed.

Apostandum is unable to provide its players with any advice whatsoever in particular not in fiscal or legal matters.

These Terms and Conditions are posted on the internet in various languages. In the event of any conflicting foreign-language versions, the Spanish version will prevail.

In some countries it can be possible that the payout of winner amount will be taxed. It will be the player’s responsibility to pay this tax.

Miscellaneous

The lotteries and gaming authority is the regulatory body supervising the operation of Apostandum.com. Apostandum.com holds a provisional sports pool betting license (LGA/CL3/362/2007). The poker and casino are not licensed in Malta.

Any complaints regarding our service should be addressed to support@apostandum.com. We will endeavour to reply within a reasonable timeframe (usually within 2 working days). If you still feel that your matter was not resolved to your satisfaction, you have the right to refer the matter directly to the authority to the following email address complaints@lga.org.mt

The legal relationship between the player and Apostandum, shall be governed by Maltese law. Any and all disputes in connection with each bet shall only be settled by the competent court having local and subject-matter jurisdiction in Malta.
